The Supreme Court of Canada as a Political Institution

The Supreme Court of Canada has long been recognized as an important political actor, even more so since the adoption of the Charter of Rights and Freedoms in 1982. Despite this recognition, the court as an institution still remains something of a mystery. While increased attention has been paid to the way that judges are appointed, and there are scattered accounts of what goes on behind the scenes at the court , there is no systematic account of how the court works as an institution. The lecture proposes a framework for the systematic study of the court’s institutional features, and presents some preliminary evidence of what can be gained from studying the court as a political institution.
